Once you have found a property that you are interested in, it is very important that a title search be obtained on the property since the Clerk’s Office does not guarantee a clear title and is not responsible for any encumbrances on the property after the property is purchased at auction. Foreclosure Sales are held at 140 W Flagler St., Suite 908 at 11:00 A.M. When reviewing the files the sale date will be specified.
At the time of the auction if you become the successful bidder you must immediately deposit in cash or cashiers check 5% of your bid. By 3:00 p.m. that afternoon the balance of your bid, plus costs must be paid in cash or by cashiers check. The purchaser of property will be issued a Certificate of Title. This title contains no warranties.
The Certificate of Title will be recorded on the eleventh day after the sale. If the tenth day is a non-business day the next business day will be treated as the tenth day. The defendant has ten days to object to the sale. If objections are filed, the Judge will rule at a hearing as to whether or not a Certificate of Title is to be issued. If the defendant files bankruptcy the Clerk is stayed from issuing a Title or taking any action, pending further order of the Court.
